Patents

Patents protect the function, structural, and procedural aspects of your intellectual property.  Patents are broadly categorized as utility, design, and plant. Plant patents allow inventors to protect their distinct and new varieties of plants.

UTILITY PATENTS

These patents are issued for the invention of a new and useful process, machine, manufacture, or composition of matter, or a new and useful improvement thereof, it generally permits its owner to exclude others from making, using, or selling the invention for a period of up to twenty years from the date of patent application filing, subject to the payment of maintenance fees. Approximately 90% of the patent documents issued by the USPTO in recent years have been utility patents, also referred to as "patents for invention".
Utility patents can be obtained for not only new devices, in terms of structure and function, but also new processes and methods.

DESIGN PATENTS

These patents are issued for a new, original, and ornamental design embodied in or applied to an article of manufacture, it permits its owner to exclude others from making, using, or selling the design for a period of fourteen years from the date of patent grant. Design patents are not subject to the payment of maintenance fees. Please note that the fourteen year term of a design patent is subject to change in the near future.

The design for an article consists of the visual characteristics embodied in or applied to an article.

Since a design is manifested in appearance, the subject matter of a design patent application may relate to the configuration or shape of an article, to the surface ornamentation applied to an article, or to the combination of configuration and surface ornamentation.

Design is inseparable from the article to which it is applied and cannot exist alone merely as a scheme of surface ornamentation. It must be a definite, preconceived thing, capable of reproduction and not merely the chance result of a method.

In design patents,the subject matter which is claimed is the design embodied in or applied to an article of manufacture (or portion thereof) and not the article itself. These patents cover ornamental and aesthetic improvements in designs.
